論刑事訴訟中公、檢、法3機(jī)關(guān)的關(guān)系

摘  要
：我國(guó)刑事訴訟中對(duì)抗制訴訟模式因素的借鑒與引入，推進(jìn)了我國(guó)司法體制尤其是審判方式的改革。但經(jīng)過10來年的檢驗(yàn)，現(xiàn)行刑事訴訟法的缺陷和不足逐漸得以暴露。在刑事訴訟法的修改再次引起廣泛關(guān)注之時(shí)，有必要對(duì)我國(guó)刑事訴訟中公、檢、法3機(jī)關(guān)的關(guān)系之現(xiàn)狀進(jìn)行考察，結(jié)合西方兩大法系的理論與制度安排，提出改革我國(guó)刑事訴訟中3機(jī)關(guān)的關(guān)系的理論思考和制度設(shè)計(jì)。
